Should You File A Magistrate Case in Allegheny County? Pghfirm.com
The Magistrate Courts in Pennsylvania serve a couple different purposes, some of those are fundamentally criminal cases. Whether it is holding preliminary hearings in more serious offenses, or summary hearings for your traffic tickets or public citations, things like that. The Magistrates also hear civil cases. Now, the Magistrates only hear civil cases that a Plaintiff chooses to bring there and those are typically cases either for possession of real property (what we would call an eviction) or for damages for $12,000 or less. One thing to note about Magistrate hearings in civil cases is that they are what we call appealable as a matter of right. What that means is that you don't have to explain a reason for or cause for your appeal. If you go to Magistrate and are not happy with the outcome you have an absolute right to file an appeal and go before the Court of Commons Pleas.
