MillerCoors, Stone Brewing File for Summary Judgement in Trademark Case
Stone Brewing and MillerCoors have each filed for summary judgement in their ongoing trademark infringement lawsuit, according to Libation Law Blog.
In February 2018, the San Diego-based craft brewery filed a lawsuit against MillerCoors, claiming its rebranded Keystone packaging caused marketplace confusion.
In its latest brief, Stone Brewing claimed that its brand and trademark would be “destroyed” should MillerCoors succeed “in supplanting Stone’s craft beers with Keystone as ‘STONE’ in the minds of consumers.”
Meanwhile, MillerCoors called the lawsuit “a publicity stunt” by Stone and claims that it was the first to use the “Stone” and “Stones” marks.
“Stone Brewing is failing [to] keep pace in an ever more crowded craft beer segment and needed to revitalize its now-outdated image as an iconoclast,” MillerCoors’ brief said. “Stone Brewing’s market is increasingly populated by beers that are rated in official beer tastings as simply better than Stone Brewings’ ‘strong and unapologetically flavorful hops.’”
Stone Brewing’s motion for preliminary injunction to ban the sale of Keystone products prior to a court hearing was denied earlier this year.
Bell’s Brewery and Loveland Distributing Co. Headed to Richmond Circuit Court
The legal dispute between Michigan’s Bell’s Brewery and Richmond, Virginia-based wholesaler Loveland Distributing Co. is heading to Richmond Circuit Court, according to Richmond Biz Sense.
As Brewbound reported in October, when Premium Distributors of Virginia, a subsidiary of the Reyes Beverage Group, reached a deal to acquire Loveland Distributing Co., which had been selling Bell’s beer since 2015. According to reports, Bell’s had been attempting to terminate its contract with Loveland prior to the closing of the transaction due to the wholesaler not sharing crucial information regarding the deal. Bell’s ultimately ceased shipments to the state.
The Virginia Alcoholic Beverage Control Authority ordered the sides to enter arbitration in May, however, the ABC reversed course in July, saying only a Virginia circuit or district court could compel arbitration.
Bell’s is appealing the order in hopes that Virginia ABC will determine it does have the authority to order arbitration, which Bells’ and Loveland’s contract calls for in the event of termination.
Guns N’ Roses, CANarchy Settle Lawsuit
Rock band Guns N’ Roses has settled its trademark infringement lawsuit against the CANarchy
Craft Brewery Collective, which sold a rosé beer called “Guns ‘N’ Rosé ale” and merchandise without the band’s permission, according to Reuters. The two sides reached a settlement agreement on July 31, and both sides are currently working on a written settlement that would dismiss the lawsuit, the outlet reported.
Cumberland Farms Files 2020 Ballot Initiative to Lift Cap on Liquor Licenses
Massachusetts-based convenience store chain Cumberland Farms this week filed a proposed 2020 ballot question to lift the cap on the number of liquor licenses a single retailer can hold. Beer and wine is currently sold in just seven of the chain’s 206 Massachusetts stores.
The question proposes a new food store beer and liquor license with no statewide cap that would be subject to local approval. Before hitting the ballot, the proposal must be certified by the attorney general’s office, garner 80,000 signatures, and be presented to the state Legislature.

Episode 13 - Beer Me! - Justin Smith Godfather of National Beer Day Speaks
In this Episode, Michael talks with Beer Me!’s Justin Smith “Godfather of National Beer Day”. Justin shares his vast experience with the Craft Beer Scene and the origins of National Beer Day (April 7).
National Beer Day is celebrated in the United States every year on April 7, marking the day that the Cullen–Harrison Act was enacted after having been signed into law by President Franklin D. Roosevelt on March 22, 1933. This led to the Eighteenth Amendment being repealed on December 5, 1933, with ratification of the Twenty-first Amendment to the U.S. Constitution. April 6, the day prior to National Beer Day, is known as New Beer's Eve
Upon signing the legislation, Roosevelt made his famous remark, I think this would be a good time for a beer. The law went into effect on April 7 of that year in states that had enacted their own law allowing such sales. The beer could contain up to 3.2% alcohol by weight (or 4.05% by volume) compared to the 0.5% limit of the Volstead Act, because 3.2% was considered too low to produce intoxication.
People across the country responded by gathering outside breweries, some beginning the night before. On that first day, 1.5 million barrels of beer were consumed, inspiring the future holiday.
Today, April 7 is recognized as National Beer Day and April 6 is known as New Beer's Eve
The Cullen-Harrison Act was not the official end of prohibition in the US (that happened on December 5, 1933 when the 21st Amendment was ratified). What the Cullen-Harrison Act did do was redefine an intoxicating beverage under the Volstead Act. As such, April 7 is a beer specific holiday and should not be confused with Repeal Day celebrated on December 5.
National Beer Day was first created in 2009 by Justin Smith of Richmond, Virginia.[10] After much prodding from his friend, Mike Connolly, Smith started a Facebook page that was noticed by Colorado Beer Examiner, Eli Shayotovich. Smith's promotion of the new holiday via various social media outlets was rewarded when the beer drinking app, Untappd, created a badge for National Beer Day that rewarded participants that checked a beer into the app on April 7.[11] National Beer Day has since been trending every year on April 7 using the hashtag #NationalBeerDay.[citation needed]
National Beer Day was officially recognized by Virginia Governor Terry McAuliffe in 2017
National Beer Day was officially recognized on the Congressional Record by Congressman Dave Brat in 2017.
In 2018, House Joint Resolution 90 was introduced in Virginia General Assembly to officially recognize National Beer Day in the Commonwealth of Virginia.

Producers Scale Back 3.2 Beer
With only one state left to require it, brewers of 3.2% alcohol by weight beer are scaling back production, according to the Minneapolis Star Tribune.
Both Heineken and Constellation Brands announced they will no longer brew the weaker beer, which Minnesota grocery and convenience stores are limited to selling.
Utah loosened laws to permit sales of 4% alcohol by weight beer last month, leaving Minnesota the only 3.2 state left.
A-B Partners Tilray and Fluent Beverages Announce CBD-Infused Tea
Anheuser-Busch InBev joint venture Fluent Beverages and its Toronto-based cannabis partner Tilray, announced Everie, a new ready-to-brew, CBD-infused tea, according to FoodBev Media.
Everie will be available in biodegradable tea bags, each with 10 milligrams of CBD and fewer than 0.05 milligrams of THC. The tea comes in three flavors: lavender chamomile, vanilla rooibos, and peach ginger green.
The tea is available in select provinces in Canada; a line of sparkling beverages is planned for early next year.
Truly Hard Seltzer Takes Flight; Sponsors NHL Winter Classic PreGame Celebration
Truly Hard Seltzer will be available on American Airlines flights beginning January 1, according to a spokesperson for the Boston Beer Company.
Truly Wild Berry will be available for purchase in 12 oz. cans on all flights that offer alcoholic beverages.
This is Truly’s second placement in the skies, following last month’s announcement that it would be available on JetBlue flights. The brand is currently the only hard seltzer available on U.S. flights.
In other Truly news, Truly is the lead sponsor of the NHL Winter Classic’s PreGame party, which will take place on January 1 in Dallas, Texas.
Cans Propel Allagash Brewing to More Than 100,000 Barrels in 2019

Allagash Brewing Company estimates its sales volume surpassed the 100,000-barrel mark in 2019, due to packaging its flagship Allagash White and River Trip session ale in cans for the first time.
After a successful regional introduction in 2019, the Portland, Maine-based craft brewery announced today plans to expand distribution of its canned offerings to additional markets and the addition of 12-packs.
After rolling out Allagash White and River Trip 4-packs of 16 oz. cans in Maine, New Hampshire, Vermont, Massachusetts, Connecticut, Rhode Island, New Jersey and New York in the spring, and then adding Virginia, Illinois and Washington, D.C., in the fall, those offerings will now be sold throughout Allagash’s 17-state footprint by February 2020.
Citing data from market research firm IRI, Allagash White cans are the No. 1 selling new item in the craft beer category in the Northeast.
Allagash is the 30th-largest craft brewery in the country, according to not-for-profit trade group the Brewers Association (BA).
Allagash will also add a Maine-exclusive beer, Sixteen Counties, an ale brewed with malts grown in the state, in 16 oz. 4-packs to its yearound can lineup.
Allagash is among the last large, regional craft breweries to add can packaging. The company released its first offering, Hoppy Table Beer, in April 2018 after installing a small canning line.
