During 1960 a Rancher in Hays County Texas gave the United States Department of Agriculture – Natural Resources Conservation Service (USDA-NRCS) permission to construct a floodwater retarding dam on his 218 acre ranch. The primary purpose of the flood control dam is to protect lives and property by reducing the velocity of floodwaters, and thereby releasing flows at a safer rate.
The flood control dam was built with the understanding that the property owner would provide the land; the federal government would provide the technical design expertise and funding for construction. An easement was granted to a local Sponsor, Plum Creek Conservation District (PCCD) to ensure the dam was maintained in the future.
Eventually, the original owner subdivided his property and sold it. During 1985 (prior to the occupancy of current owners) the City of Buda, Texas starting releasing its wastewaters into the drainage easement area of a flood control dam. By the time the current owners arrived (I came in 1988), there was a small “lake” in the rear of some properties. Our little lake never dried even during the worst of droughts and it kept expanding.
I learned in 2012, that our “lake” is actually the City of Buda wastewater detention pond. Now the wastewaters have grown to the point that an entire community is flooding. My community has experienced 2 major floods (Halloween 2015 and Memorial Day 2016) within seven months.
The easement from the original property owner carried forward to the current owners. In 2011, Hays County also became a Sponsor for the flood control dam at Goforth Road and High Road near Kyle, Texas. One of the roles of the Sponsor is to ensure the easement is not violated. Yet, the City of Buda wastewaters are occupying the floodwater drainage easement space. Therefore, when heavy rain and flood waters arrive, they are forced further onto properties and into homes.
The City of Buda wastewater permit includes a TCEQ disclaimer that reads as follows:
“The issuance of this permit does not grant to the permittee the right to use private or public property for conveyance of wastewater along the discharge route described in this permit. This includes, but is not limited to property belonging to any individual, partnership, corporation, or other entity. Neither does this permit authorize any invasion of personal rights nor any violation of federal, state, or local laws or regulations. It is the responsibility of the permittee to acquire property rights as may be necessary to use the discharge route.”
The City of Buda never asked for nor was granted permission to discharge their wastewaters from the private property owners. And they never expected the owners to learn the truth. Now that the secret has been exposed and properties are flooding, it’s time for the City of Buda to accept responsibility.
Hays County Development Regulations
A Development Authorization is required for all development in the unincorporated area of Hays County. Development is defined as “all land modification activities, including the construction of or additions to buildings, roadways, dams, paved storage areas, parking lots, storm water management facilities and other impervious structures or surfaces.” All divisions of land within Hays County are subject to the Hays County Development Regulations.

OPEN CARRY ~ POLICE HARASSMENT ~ BUDA, TEXAS
On July 9, 2013 at 4:40pm in Buda, Tx me as well as one other law abiding Texas citizen. Began to exercise our right to open carry a long gun. At 5:27pm Officer Alex Fernandez with Buda P.D. drove up and began to try to run all over my rights. He never once asked what we were up to. He just jumped out of the car and demanded my ID. A constable shows up as back up. I refused to show ID, he said I was detained and going to jail. He goes on to tell me has been receiving multiple calls (later he says it was only 1 call a few times). I asked for his supervisor he said you will get me. I proceed to give officer Fernandez a business card that explains my rights to open carry. Officer Fernandez reads the card then says he will give me a few seconds to think about it, meanwhile he goes to car to get on radio to ask what he can do, I am assuming. Meanwhile the constable backs the Officer and tells me that I have to by law show ID (once again ALL LIES). The officer comes back from car says I am being detained for suspicious activity we dont have everyday someone walking around with a gun he says. Officer Fernandez says I am trying to go to jail because I am a IDIOT. He then proceeds back to the car to get on radio to see what he can do. At the beginning I had asked for his supervisor to avoid all of this. He comes back to talk to me after his supervisor told him there was nothing he could do, he called me now annoying and retarded. He also says he knows it is a FUN GAME for me. Off and on he places he hands in the ready position for his side arms, and tries to provoke me. He consistently will not answer my questions (it is his job to serve RIGHT?) He says he supports my rights, I then ask him how can I exercise my rights and still ignores me. At the end I thank the constable for being polite (even though he showed ignorance for the law, he did like the business card). The whole encounter with the officer he never asked me what I am doing, the other thing also he never said one word to the other person next to me with a long gun strapped on their back.........

Taken August 9, 2019. Sorry if I sound tired. Like I said in the video I went to Busch Gardens and spent the whole day there. It was a lot of fun. I have found 3 elevators there, one in a completely different part of the park. The park itself was big. It was an amusement/museum/zoo/aquarium. But anyway, this is the tallest Schindler 330A I've ever been on. The was a VERY NICE place. This Condo has a country club & golf & tennis attached to it. This video will also include MY VERY FIRST MACHINE ROOM VIEW!!!!!!!!!!!!!!!!!!!!!!!! Huge thanks to the front desk clerk for letting me check out the machine room!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!! This was a nice elevator installed in 2000. Open Carry Academy Austin, Tx
On Sept 7 2013 me as well as one other person decided to open carry as we do very often and do some shopping at Academy. Academy allows open carry and the policy is clearly stated on the entrance door. We walked right in and proceeded to the firearm section. Academy employees were up to speed with the laws pertaining to open carry as you see in the video. We decided to turn off the camera after the interaction we had we felt that we would not have any problems, we were wrong. About 10 minutes after we turn the camera off we are approached by a manager named Nelson Ripoll. He stated to us that Academy's policy does not allow open carry. We then showed him the policy that is posted on the entrance. Nelson said that he understood that we are not breaking any laws or causing any kind of disturbance but said he will not honor the policy in place. He then told us if we wanted to continue to shop that we need to give them our firearms. We replied to him we would not disarm ourselves and he said that we would have to leave. We complied with the request to leave the store, but we feel our civil rights were violated. This was at the location off I35 and William Cannon in Austin, TX.
