India is, without a doubt, one of the marvels of the 21st century from an economic standpoint, especially when viewed in the context of where it was just a century ago. To be clear, not all the manufacturing jobs in the region benefit the overall economy rather than Western interests, but that’s a story for another day. White Star Yard Tour - West Harbour Hamilton Summer 2011
Gallery 205 presents a video tour of the White Star lands situated down by the Hamilton West Harbourfront. For this summer of 2011 it will be lovingly referred unofficially as the White ROSE Labyrinth & Sculpture Garden project (something to that effect, but you get the idea), in honour of Jack and Rose Rothstein (see more below). With the help of many, this will be the first Hamilton Ontario Sculptors Guild outdoor summer project with special help by the White Star Group and friends of Gallery 205.

A bureaucratic train wreck derails development and leaves a property in limbo for 22 years

Perched atop the West harbour is White Star Auto Wreckers operated for 42 years by Jack Rothstein who had taken over the operation from Morris Mandel and later married his daughter Rose. Jack operated White Star and Rose managed the property. In the 80's as both Rose and Jack were now getting on in years they wanted to retire and sell the property for redevelopment. Rose, already embroiled in a property tax dispute with the City, began working with Hamilton developer, the Cupido Group. Rose's plan was to develop their property along with the lands south and north of theirs, at that time owned by members of her extended family. To that end the Cupido Group submitted an application for an official plan amendment to rezone the lands from Commercial-Industrial to Medium Density Apartments.
On December 20, 1989 Hamilton City Council passed the zoning amendment subject to the following conditions; that the lands be subject to an environmental study and a noise and vibration study. CN Rail and Rheem Canada were the only objectors. Mayor Morrow also requested that City Staff meet with Rheem and CN Rail to ensure that their concerns about the development would be resolved and that the environmental noise and vibration guidelines could be met. There is no record that City staff actually met with the parties.
The delays around resolving the issues with Rheem Canada and CN Rail, and the tightening of the environmental laws in the early 90's forced the Cupido Group not to renew their offer to purchase.
Rose continued her fight with City Hall over the property taxes and their inaction on the Rheem and CN issues. Rose, Jack and other Mandel family members who owned the adjacent properties were getting increasingly concerned about the environmental liabilities that they might be facing, not fully understanding the new and changing regulations. No resolution seemed to be in sight, only more years of uncertainty and financial hardship.
On June 27, 1995, The Department of Public Works presented The West Harbourfront Development Study to City Council. The vision statement is as follows; to establish the West Harbourfront as a place for public use and enjoyment; a place for protection of the natural environment; a place to live, work and play; a place to expand our tourism industry; and a place of which all Hamiltonians can be proud.
The Public was informed about the draft plan through a large article in The Spectator. The preliminary cost estimates came in at just under $1 billion. Included in this estimate was approximately $100 million for the relocation of the CN Rail yards. The initial excitement quickly dissipated. This project created a huge rift between the Public Works and Planning Departments. As Planning had not been the lead on the project, they did not support the West Harbourfront Study. A project that had cost millions of dollars of taxpayer's money was shelved and copies were no longer available through City Hall. Hope quickly fades as well for the Study making any difference to Rose and
Jack situation.
The years march on and nothing happens until 1997. There is a chance meeting between Alan Mandel, Rose's cousin and Hamilton entrepreneur and developer, Marino Rakovac. Tax arrears and penalties on the White Star site and adjacent properties had now skyrocketed to over $600 thousand. This, combined with the potential environmental liability still looming, made Rose and Jack's situation even more desperate. Marino arranged to meet the Rothsteins and offered to take over the project by paying the tax arrears and assuming the environmental liability. Rose, Jack and the rest of the family were relieved that their nightmare was coming to an end and agreed to the plan. Rose's parting words to Marino were I hope that you'll have better luck dealing with the City than I did!
