What is my injury case worth? | Jones Law Firm
One of the most common questions the Alexandria, LA personal injury lawyers at the Jones Law Firm are asked is: How much is my case worth? But, the truth is, the answer to this question isn’t something that can be determined right on the spot. There are many things that need to be taken into consideration that will be used to determine what your case is actually worth. One thing you have to remember is that every case is different. Because the circumstances vary, the value of your case is going to differ from another case where someone may have sustained more severe injuries or more damage was done to their property.
But, one of the ways the value of your case is determined is with the help of the civil courts. The civil court compensates victims of accidents for their injuries and damages. Because the courts can’t mend your injuries and relieve you from the suffering you might be experiencing, they remedy the situation by providing you with compensation for your damages.
That brings us to yet another question that is commonly asked which is:
What are damages?
If you’ve never been involved in an accident or sought out compensation for an injury, you might not know what the term “damages” refers to. So, in an effort to help you better understand, we will break it down in more detail for you below.
Damages are generally broken down into two parts. You have general damages and special damages. Special damages are things we can put an exact value on. For instance, we can total up your medical bills for all the treatment you have had to go through to help get you back to, or close to, the condition you were in prior to the injury. Other types of special damages might include lost wages, the value of your vehicle, etc. Now, general damages are things we cannot put an exact dollar value on such as pain and suffering, emotional distress, or loss of enjoyment of life. Because everyone’s life is affected differently after being injured and/or involved in some sort of accident, this dollar amount will differ from one person to the next. But, with our help at the Jones Law Firm, we can use details from your case and help derive at a fair dollar amount you feel comfortable with that can cover the general damages you have incurred.
So, essentially, your case is worth the amount of money it will take it takes to cover your special and general damages.
How are damages calculated?
Special damages are a bit easier to calculate as a personal injury lawyer will simply gather the figures and derive at an amount. Your medical bills, lost wages, and property damage can all be added together to determine how much you should receive in special damages. Now, to determine the value of general damages, the state of Louisiana will use cases from the past that involved someone who suffered a similar injury to yours. The courts, as well as the injury lawyers, would look and see how much the jury awarded that victim and try and get you close to the same settlement. We would also factor in the value of the dollar then vs. now as well as the cost of living.
Is there a formula used to calculate the value of an injury case?
It depends on the type of injury you sustained. For example, if you sustained a soft tissue injury such as a muscle strain that can generally be treated with a few months of chiropractic care or physical therapy, most who have undergone the same type of treatment received approximately $3,000 per month of active treatment. However, if the injury is much more severe and surgery is necessary, it could be worth $220,000-$300,000, but again, we could refer to a case where someone had the same treatments rendered to determine what they received in damages and use that as a starting point for your case.
Now, although it is difficult for us to place a dollar amount on a case during the first meeting, after some time and assessment, it will become easier for our Louisiana personal injury attorneys to provide you with an estimate as to what you potentially could receive in damages. We will consider things like:
• What your life was like before and after the accident.
• How the injury has affected your family.
• How your life has been impacted by not being able to work.
• The psychological impact the accident has had on you.
Because we want you to receive the maximum amount of compensation for all the pain and misery this injury has caused, while it might take more than one visit to determine what your damages are worth, you can be sure we will derive at a fair amount you will be satisfied with.

Woman Wins Suit Against Border Patrol For Illegal Cavity Searches
The ACLU on Thursday announced a $475,000 settlement reached with U.S. Customs and Border Protection for a New Mexico woman who was subjected to vaginal and anal searches that her attorneys maintain were illegal. BuzzFeed reports the woman had settled with the University Medical Center of El Paso last year for $1.1 million for conducting the search on behalf of CBP. CBP did not admit any wrongdoing as part of the settlement. The 54-year-old U.S. citizen, referred to as Jane Doe in court documents, was trying to return to the U.S. from Mexico through El Paso, Texas, in 2012, when a drug-sniffing dog jumped on her. CBP agents and employees of the University Medical Center of El Paso then subjected her to six hours of searches. When an X-ray exam showed no drugs, they shackled her to an examination table and inserted a speculum into her vagina, performed a rectal exam on her, and conducted a bimanual cavity search of her vagina. Doctors then conducted a CT scan and concluded she had no drugs. When she refused to sign a consent form for the medical exam, they billed her for $5,488.

The Nightmare World of Gang Stalking
More than 10,000 people worldwide claim they're the victims of a vast organized surveillance effort designed to ruin their lives, a phenomenon known as gang stalking. Mental health experts see gang stalking as a symptom of paranoia, but the self-identified victims who insist what they're experiencing is real have come together online and in support groups to share their stories.
VICE met up with a handful of Americans who claim their lives have been derailed by gang stalking to understand what serious consequences the phenomenon presents. Then we hear from Dr. Josh Bazell, one of many physicians who believes the victims of gang stalking are experiencing dangerous delusions that could be treated by mental health professionals.

Impeachment trial of President Trump | Jan. 23, 2020 (FULL LIVE STREAM)
Opening arguments in President Trump’s impeachment trial began on Jan. 22 in the Senate. House managers, led by Rep. Adam B. Schiff (D-Calif.), will present three days of opening arguments. Then, senators will have 16 hours to ask questions in writing. Chief Justice John G. Roberts Jr. will read the questions out loud, and the appropriate side — defense or prosecution — can answer them.
President Trump was impeached by the House of Representatives in December for abuse of power and obstruction of Congress. Impeachment does not mean that the president has been removed from office. In the next phase, the Senate must hold a trial to make that determination. A Senate impeachment trial has happened only two other times in American history and once in the modern era. At the center of the Democrats’ case is that Trump sought to withhold military assistance and an Oval Office meeting until Ukraine announced investigations into former vice president Joe Biden and his son.

President Donald Trump appeared before a divided Congress for the first time to appeal to lawmakers' sense of unity at a moment of deepening partisan spite.
His calls for conciliation were met with mostly stone-faced silence from Democrats, who bitterly oppose his agenda and accuse him of hastening the decline in cross-party cooperation. It was his first time addressing the Democratic-majority House, and his political nemesis, House Speaker Nancy Pelosi, offered applause only sparingly.
We must reject the politics of revenge, resistance and retribution, Trump told Congress near the beginning of his State of the Union address, claiming in his speech that he is putting forward the agenda of the United States.
Yet it didn't take long for Trump's irritation at Democrats to rise to the surface.
An economic miracle is taking place in the United States -- and the only thing that can stop it are foolish wars, politics or ridiculous partisan investigations, the President said to only a smattering of applause. If there is going to be peace and legislation, there cannot be war and investigation. It just doesn't work that way!
Democrats have promised they will use new investigative powers to probe everything from Trump's tax returns to his policy decisions to members of his Cabinet. The special counsel Robert Mueller is also continuing his look into Russian meddling in the 2016 election.
