Luis Rodriguez killed by law enforcement at Warren Theater parking lot in Moore, Oklahoma
On February 15th, 2014, Luis F. Rodriguez was killed in the parking lot of the Warren Theater in Moore, Oklahoma. The men responsible were Police Officers Ryan Minard, Joseph Bradley, and Brian Clarkston of the Moore Police Department and Wildlife Wardens Tyler Howser and Chad Strang of the Oklahoma Department of Wildlife Conservation.
The Oklahoma Medical Examiner ruled Mr. Rodriguez's death due to cardiac arrhythmia from physical restraint. An independent medical examiner's autopsy revealed that Mr. Rodriguez's death do to asphyxia.
Moore, Oklahoma, District Attorney Greg Mashburn refused to charge the officers involved, stating that Mr. Rodriguez's death was not due to the officers' conduct.
Background:
The chilling video that had been confiscated by police showing five Oklahoma cops piling on top of a man in a movie theater parking lot earlier this month, leading to his death, was released today, showing the cops were struggling with what appeared to have been a dead man for five minutes. After all, Luis Rodriguez, 44, was not only not resisting, he was not even moving during the duration of the video. But still, you can hear one of the cops say, “calm down, sir,” as he pushes his face into the pavement.
Rodriguez’s wife, who was video recording, kept pleading for her husband to respond, but he said nothing. It wasn’t until several minutes into the video that she realizes he is dead.
One of the cops walks up to her to try and reassure her everything is under control as she is panicking. He ends up grabbing her phone, not in a coercion manner, but she is under no condition to even question this move, having just seen her husband killed.
The incident began when Rodriguez’s wife slapped their 19-year-old daughter over an argument, then stormed off, which prompted her husband to run after her. But the cops intervened, demanded his identification. Family members say he tried to step around them to get to his wife. Police say he became combative.
A surveillance video from the movie theater might have captured the entire incident, but that has not been released.

MOORE, Oklahoma -A lawyer for the family of a man, who died outside the Moore Warren Movie Theater while in police custody, has released a video of the incident.
Luis Rodriguez died earlier this month after a confrontation with police outside the theater in Moore.
Police say the 44-year-old Rodriguez became uncooperative when officers questioned him about a possible domestic disturbance. Police handcuffed the man.
Rodriguez's wife and daughter say police then started beating him. Autopsy results are pending.
The Rodriguez family's lawyer released a cellphone video of the incident and a statement at a Tuesday news conference in Oklahoma City.
The video shows 44-year-old Luis Rodriguez on his stomach on the ground outside the theater with five police officers restraining him. One officer holds Rodriguez's head down and the others are on top of him as they handcuff his hands behind his back.
Rodriguez's wife, who shot the video, is later heard screaming and asking if Rodriguez is dead as he is placed on a stretcher.
He was not involved in the disturbance. However, when police came, they focused their attention on Luis. Taking him face down onto the pavement, pepper-spraying his mouth, nose and eyes and putting the weight of five grown men on top of him, and then handcuffing him as he was unconscious or already dead, said Michael Brooks-Jimenez, attorney for the Rodriguez family.
Moore Police Chief Jerry Stillings said he stands behind his officers' actions and said he did not see anything inappropriate on the cell phone video as far as his officers' actions.
There is security camera footage from the Warren Theater. However, that has not yet been made available for us to see.

Police Brutality: Moore, Oklahoma, police 'beat father to death as family watches
Warren Theaters in Moore, Oklahoma, was the scene of a tragic incident on Friday night when father Luiz Rodriguez was allegedly beaten to death by five police officers in front of his family.
According to his still stunned family, they were leaving the theater around midnight on Friday when mother Nair Rodriguez and her daughter Lunahi got into an argument. Nair slapped Lunahi and stormed off.
Luiz ran after his wife when he was confronted by police officers who asked him for identification.
Fearing his wife was about to drive off, Rodriguez tried to push past the cops when, according to his family, they took him down and things escalated.
Lunahi says that five cops then ruthlessly beat her father to death, describing repeated blows to his head, right in front of her. She says her mom recorded footage of some of the incident on her mobile phone.
The distressed daughter then told a local TV station how she watched her dying father's as he was being carried away for the last time.
She added that following the incident the police then confiscated her mother's cellphone and have not returned it.
The family said that they plan to hire an attorney.
Moore Police Department refused to comment, but has said that three officers have been put on paid administrative leave while an investigation into the 'in-custody' death is carried out.

Police in Moore, Ok have their panties in a bunch after the widow of a man killed during an encounter with Moore's finest posted a video to Facebook pleading for justice for her husband.
Luis Rodriguez died during a scuffle with police in the parking lot of the Moore Warren Theatre on Valentine's Day 2014. In cell phone video taken by his wife Nair, Luis Rodriguez is heard saying three words that have become a rallying cry against police tyranny, I can't breathe.

The family of a man who died after a struggle with police outside an Oklahoma movie theater released a cellphone video on Tuesday, which shows five officers restraining the man face down on the ground, with one officer holding his head forcefully down.
Minutes later, Nair Rodriguez, who shot the nearly 6-minute video of her husband, Luis Rodriguez, outside a Moore theater earlier this month, starts to scream as he's placed on a stretcher.
'Papa! Is he OK? He doesn't move. He doesn't move! You kill him! You kill him! You killed my husband! Please somebody tell me that he's alive!' she screams.
A police officer assures Nair Rodriguez that her husband is alive and that medical personnel will take care of him. He died later in hospital.
The family's attorney has just released cell phone video showing some of what happened the night Luis Rodriguez died in the custody of Moore police.
Luis' wife, Nair, took the video.
Attorney Michael Brooks-Jiménez, who is representing the Rodriguez family, said, Luis committed no crime. He wasn't armed. No gun. No knife. No weapon of any kind. But Luis was the one who lost his life that night.
In the video you hear Nair Rodriguez yelling for police to leave Luis alone.
The video shows five officers detaining Mr. Rodriguez.
It then shows officers sitting him up, supporting him.
His family members said they believe he was not breathing at that time.
Mr. Rodriguez was then put into an ambulance.
Officials said Luis later died at the hospital.
The investigation into Mr. Rodriguez's death was handed over to the OSBI last week.
Mr. Rodriguez died Feb. 15 after being taken into custody outside the Warren Theater in Moore.
His family says police beat him.
Moore (Oklahoma) is Booming with New Businesses
In spite of the current economy struggles, new businesses continue to open in Moore, Oklahoma.
Moore City leaders said the community's location, which is located off Interstate 35, has had a positive impact on their economic standing.
Sen. Anthony Sykes (R-District 24) said first impressions are also making a difference.
Developers are still planning to open a new shopping center in the area, which will include Bed Bath & Beyond, Pet Smart and Chick-Fil-A.
Sales are strong, City Manager Stephen Eddy said. We're pretty well countering what we're hearing in the national news here.
As the economy slows, city leaders of Moore remain optimistic. They call themselves Forward Thinking and plan to stay that way, which is a big selling point for big businesses.

What began as a fun night out to the movies ended in tragedy for one Oklahoma family after a father was beaten to death by police following a domestic dispute, CNN reported.
The incident, which was caught on video, began when Mrs. Nair Rodriguez got into an altercation with her 19-year-old daughter outside the Moore Warren Theatre in the early hours of February 15 and slapped her. A bystander who witnessed the incident reported the event to police.
The mother-daughter disagreement had upset Mrs. Rodriguez so much that she had bolted for the family car. Her husband, Luis followed her to calm her down when he was intercepted by five police who arrived on the scene. However instead of confronting Nair, five cops took down her innocent husband Luis Rodriguez, beating, pepper spraying and pinning him on the road.Five guys got on top of him, beating him ruthlessly. On the head-- just pow, pow, pow. Even with knees, Luis' daughter explained. When they flipped him over you could see all the blood on his face, it was, he was disfigured, you couldn't recognize him,.
In a state of shock, Nair Rodriguez took out her phone and recorded the final moments of the police brutality where she can be heard screaming and demanding officers to stop as her husband appears lifeless.
Luis! Luis! Please somebody tell me that he is alive, she implored. He is not moving, she screams.
The police responded to Ms. Rodriguez by telling her they had called a medical unit.
Rodriguez can be heard demanding to know why they pinned down her husband to which officers replied, He refused to give his ID.
Luis was then taken to hospital where the family was hopeful he would pull through. However, Luis was soon pronounced dead after he stopped breathing.
The family's attorney Michael Brooks-Jiménez said it's not clear why police took Luis down because the argument was between Nair and her daughter.
Luis committed no crime. He was not armed. He had no gun, no knife, no weapon of any kind. But Luis is the one who lost his life that night, he said.
Police say their actions were protocol, though three have been suspended with pay while the Oklahoma Bureau of Investigation continues to investigate.

Oklahoma police beat Luis Rodriguez to death in front of theater in front of wife & daughter
MOORE, OK -- A family's night at the movies on Valentine's Day turned into a horror show when a husband and father was beaten to death outside a cinema by police officers.
Things had not gone smoothly for the Rodriguez family -- who reside in Norman, OK -- due to a dispute which took place between Mrs. Nair Rodriguez and her 19-year-old daughter, Luinahi. Mrs. Rodriguez says her daughter had been lying to her so she slapped her during the argument, which took place outside the Warren Theater during the early hours of February 15th.
A bystander reported the incident and got the government involved. A bad situation would soon turn horribly worse.
Mrs. Rodriguez had stormed away from her daughter, upset at what had happened. Luis went after her to calm her down. That's when several Moore Police officers approached.
Luinahi and Nair both witnessed what happened next. They say Luis, age 44, tried to bypass the officers as they were attempting to ask him for identification. Luis didn't want his wife to drive away while she was angry, so he continued towards her.
That's when Mr. Rodriguez was taken down, and beaten to death by five officers. His family witnessed him getting pummeled with fists, knees, and pepper spray until he was bloody and lifeless.
Five guys got on top of him, beating him ruthlessly. On the head-- just pow, pow, pow. Even with knees, Luinahi tearfully explained.
Mrs. Rodriguez pulled out a cell phone to record the incident. I'm recording because this is too much, she says.
Her video began after the brutal beating was over, and only captured the moments when Luis was already on the ground, being pressed into the cement by five men, and then loaded onto a stretcher.
Even though the man is on the ground, motionless, officers tell him to calm down, as he suffers under the weight of several police officers. They handcuff him with ease and slowly roll him over, revealing his battered appearance. He cannot sit up under his own strength.
Papa? Are you OK? asks his wife of 22 years. Then a stretcher rolls out and the gravity of the situation sets in. Is he OK?! He doesn't move! You killed him! You killed my husband!
