Claiming for the Preah Vihear temple
REPORT: On the Thai-Cambodian border, the two countries are in a stand-off over the area of land surrounding the Preah Vihear temple. (C. Payen)
Preah Vihear Temple: A UNESCO World Heritage site in Cambodia
Preah Vihear is a 9th century temple complex atop a 500 meter high mountain on the border between Cambodia and Thailand. Following the temple's designation as a UNESCO World Heritage Site in 1998, Thailand claimed that part of the access route to the temple complex lay within its borders, making the temple inaccessible from Cambodia. A dispute - briefly violent - ensued between the two countries. In 2013, the International Court of Justice ruled in favor of Cambodia's claim, and the site was reopened to visitors.

Professor Gillian Triggs on the Temple of Preah Vihear
Professor Gillian Triggs examines the complicated boundary dispute concerning the Temple of Preah Vihear on the border of Thai-Cambodian border.
She discusses:
- Why is this case of interest in international law
- Historical content and why the issue arose
- How cultural attitudes to the court and expectations regarding the rule of law impacted on the outcome of the dispute
- The implications of there being no system of appeal
- The current situation and implications for international boundary disputes
Since filming this interview, Cambodia (on 2 May 2011) filed an application with the ICJ requesting interpretation of the earlier Judgment of the Court on 15 June 1962 and also an urgent indication of provisional measures. Cambodia argues, inter alia, that the 1962 Judgment is based on the prior existence of an international boundary established and recognized by both states and that Thailand is obliged to withdraw from the vicinity of the Temple situated on Cambodian territory. The public hearings on the Request for the indication of provisional measures were concluded on 31 May 2011.
Gillian Triggs is the author of 'International Law: Contemporary Practice and Principles', which provides comprehensive coverage of contemporary cases in international law, including essential sources, treaties, jurisdiction, personality, territory, law of the sea, state responsibility and sovereign immunity, as well as coverage of specialised topics, such as international environmental law, human rights and the rules of the World Trade Organization.
This video is designed to accompany Chapter Eleven: Dispute Resolution by International Tribunals.
Professor Triggs is the Dean of the Faculty of Law at the University of Sydney, and holds the Challis Chair in International Law.

Preah Vihear Temple - Preah Vihear province - Cambodia
Preah Vihear Temple (Khmer: ប្រាសាទព្រះវិហារ Prasat Preah Vihea; Thai: ปราสาทพระวิหาร; RTGS: Prasat Phra Wihan) is an ancient Hindu temple built during the reign of the Khmer Empire, that is situated atop a 525-metre (1,722 ft) cliff in the Dângrêk Mountains, in the Preah Vihear province, Cambodia. In 1962, following a lengthy dispute between Thailand and Cambodia over ownership, the International Court of Justice (ICJ) in The Hague ruled that the temple is in Cambodia.[1]
Affording a view for many kilometers across a plain, Prasat Preah Vihear has the most spectacular setting of all the temples built during the six-centuries-long Khmer Empire. As a key edifice of the empire's spiritual life, it was supported and modified by successive kings and so bears elements of several architectural styles. Preah Vihear is unusual among Khmer temples in being constructed along a long north-south axis, rather than having the conventional rectangular plan with orientation toward the east. More info visit:

Preah Vihear - UNESCO World Heritage Site
Preah Vihear is a mesmerising and special UNESCO World Heritage Site, located in the far north of Cambodia. It's a large Hindu temple complex in a very dramatic location - located on a mountain ridge high above the Cambodian floodplains. The ruins here are in fantastic condition, and were really interesting to explore. Let's have a closer look!

Preah Vihear temple border conflict between Cambodia and Thailand explained

Cambodia and Thailand will take their centuries-old border dispute back to the International Court of Justice from April 15 to 16, 2013 to ask for a ruling on where the territorial border lies.
At the centre of the dispute between the Southeast Asian countries is an 11th Cenutry Hindu temple, built under the ancient Angkor Empire (now modern day Cambodia).
Both Thailand and Cambodia laid claim to the temple before and then after French colonial rule was imposed on Cambodia, Laos and Vietnam.
In 1962 the International Court of Justice, also known as the World Court, ruled that the temple, known in Cambodia as Preah Vihear, belonged to that country.
In its judgment, the court only specified the ownership of the temple, and neglected to rule on ownership of the surrounding area, which is claimed by both countries.
When the temple was submitted by Cambodia to become a world heritage site in 2008, violent, nationalistic clashes broke out in and around the disputed area between Thai and Khmer military forces.
Brief clashes ensued that year and culminated in deadly clashes in 2011 which killed at least eight people and displaced tens of thousands.
Both countries agreed to demilitarise the disputed area, an undertaking carried out slowly over the following year.
Cambodia submitted a request for the World Court to reinterpret its 1962 decision and rule on ownership of the disputed territory.

There has been an ongoing turf war between Thai and Khmer soldiers for ownership, and it currently belongs to Cambodia. I was lucky to be able to visit during a peaceful time.

CAMBODIA: 12TH CENTURY PREAH VIHEAR TEMPLE REOPENS TO TOURISTS
Eng/Thai/Nat
A 12th century Preah Vihear temple which was once controlled by Khmer Rouge guerrillas, reopened for tourists again at the weekend.
The temple, which sits on a ridge on the Thai-Cambodia border, was at the centre of a dispute between Bangkok and Phnom Penh for many years over which country had rights to the historic site.
Now, even though the temple is in Cambodian territory, people will have access to the ancient site from the Thai side
Hundreds of tourists lined up to buy tickets to visit an ancient Khmer temple on the Thai-Cambodia border this weekend.
The 12th century Preah Vihear temple has been kept off limits for the last five years because of the civil war in Cambodia.
Many were eager to be the first to visit the ruins of the Angkor-era temple which has survived the ravages of nature and war.
Perched on a scenic cliff, the temple is a drawcard for tourists from around the world.
SOUNDBITE: (English)
Of course, it's a beautiful temple. I enjoy looking at the carvings and trying to explain to my wife. But of course I have forgotten a lot of what these carvings means. Yeah, it's very beautiful.
SUPER CAPTION: Stuart Lirentais, American Tourist
Until recently, Preah Vihear or Temple of Heaven was a stronghold of Khmer Rouge guerrillas fighting against the government.
Last March, 80 fighters controlling the mountain top since 1993 defected to Phnom Penh.
It was a key event in what's now seen as the final unravelling of Pol Pot's notorious movement.
Security is needed here to give confidence for visitors.
In 1994, two Belgian tourists were murdered by the Khmer Rouge after they somehow managed to reach the temple from Thailand.
Officials also had to clear mine fields which were laid by the guerrillas.
The wreck of a government helicopter lies nearby.
It hit a mine shortly after the defection and is a constant reminder
of the sombre past.
SOUNDBITE: (Thai)
It's shame that this place is run down by all the troubles happening here. But at least we still have a chance to appreciate the beautiful temple once again.
SUPER CAPTION: Rataka Chantaklan, Thai tourist
An official agreement over the opening of the temple has not yet been made by the two governments.
But Thai and Cambodian authorities hope that Preah Vihear will become a major tourist attraction.
A newly-built road on the Thai side will make access to a temple that has long been regarded as one of the most spectacular sites in South East Asia.

STORY LINE
Protesters on Tuesday gathered in front of Thai parliament in the capital Bangkok, demanding the government not to sign a Joint Boundary Commission with Cambodia over a disputed border line.
Thai Parliament is scheduled to discuss the Memorandum of Understanding between Thailand and Cambodia to jointly carry out the demarcation of the land along the countries' border.
Protesters from Thailand's 'Yellow Shirt' People's Alliance for Democracy (PAD) on Tuesday opposed the government's decision in fear of losing the Preah Vihear Temple near the disputed Thai-Cambodia border.
Tensions over temple ownership heated up in July 2008 when UNESCO, the United Nations cultural agency, approved Cambodia's bid to have Preah Vihear named a World Heritage Site.
Thailand initially supported the bid but then reneged after the move sparked outrage and protests.
Both sides rushed troops to the border, which resulted in several small gun battles.
Protesters said that the government is failing to pursue Thailand claims regarding the disputed land along the border with Cambodia.
We're here to claim back the Phrear Vihear Temple because it once belonged to our nation, one of the protesters said.
The World Court awarded the temple to Cambodia in 1962, but sovereignty over the surrounding land has never been clearly resolved.
Cambodia and Thailand share a 500-mile (800-kilometre) land border, part of which has never been clearly demarcated because each country relies on different maps.
