PEMBROKE
Elderly man walking in the middle of Rt. 33 allegedly discharges several shots from a pellet gun after being found by off duty trooper
At 5:18 this morning an off duty NYS Trooper was traveling on Rt. 33 just past Read road when he discovered an elderly male walking in the middle of the driving lane.
According to Lt. David Martek with the NYS Police, the off duty trooper swerved to go around the man in his mid eighties and then went back to see if he was okay.
Martek says the elderly man did not respond to the off duty trooper when he returned to see what he was doing in the road. Two pops were then heard by the off duty trooper.
The roadway was then then closed down and a perimeter was set up around the man's house.
Troopers then attempted to make contact with the man who went back inside his house.
The State Police robot approached the house and made contact with the man and asked him to come outside to talk to police.
The man did respond to that request.
Martek says it appears several shots were discharged from a pellet gun during the incident. A vehicle across the street from the man's residence was struck with a pellet in the windshield.
The neighbor will not be pressing charges according to State Police.
The investigation is ongoing and charges may by pending.
The Genesee County Sheriff's Office also assisted at the scene.
