Ghana's Supreme Court on Thursday upheld President John Dramani Mahama's win in elections last year, dismissing the opposition's case alleging voter fraud in a test for one of Africa's most stable democracies. The substantive hearing of the 2012 presidential election petition challenging the 2012 presidential election results, has come to a close at the Supreme Court of Ghana.
President Akufo-Addo suspends four Justices of Supreme Court
The President, Nana Akufo-Addo on the advice of the Judicial Council, has suspended with immediate effect, four Justices of the High Court. They are Mr. Justice Uter Paul Dery, Mr. Justice Mustapha Logoh, Mr. Justice Gilbert Ayisi Addo; and Mr. Justice Charles Quist. According to a statement issued and signed by the Director of Communications at the Presidency, the suspension follows the establishment of a prima facie case against the four Justices, by the Committee set by the Chief Justice to investigate alleged acts of bribery and corruption against certain persons, including the Justices, as contained in the 29th August, 2015 petition of Mr. Anas Aremeyaw Anas.

Supreme Court 4th Sitting On Petition

In the Election Petition Hearing at the Supreme Court today, cross examination of the 1st witness for the petitioners, Dr. Mahamadu Bawumia continued. Issues over duplicate pink sheets were the highlights of the cross examination. Both parties also argued over the number of pink sheets served by the petitioners as exhibits to the respondents on the Joint affidavit filed by the 1st and 3rd respondents. The court, overruled an application by the respondents calling for a head count of the pink sheets.

The Supreme Court has refused an application filed by a private citizen, Mrs Fafali Nyonator for an order of injunction to stop the President from appointing a new Electoral Commissioner. She prayed the court, to put on hold the appointment, until after the determination of the Substantive case which she had filed before the Court. Mrs Nyonator claimed that the Chief Justices' committee which recommended the removal of the former EC boss, Mrs Charlotte Osei, breached the Constitution.

The South Africa and Ghana delegates visit the Ghana Supreme Court with Chief Justice Georgina Theodora Wood, who explains the history of the court and the three judges whose busts face outward from it. Known as the Martyrs to the Rule of Law the busts depict three High Court judges who were murdered for upholding the rule of law during political unrest in Ghana during the early 80's.

Cross examination of the second petitioner, Dr. Bawumia by Mr. Tsatsu Tsikata entered day 5 today. Counsel for the petitioners, Mr. Philip Addison objected to a direction by Tsikata to Dr. Bawumia to identify some pink sheets from a polling station at Asokwa in the Ashanti Region as well as the fact that the witness cannot be asked questions from those pink sheets as those sheets should have been attached to the third respondents' written affidavit to the court. But both objections were over-ruled.

The Supreme Court election petition is in its 11th day today. Counsel for the NDC, Mr. Tsatsu Tsikata, in his 4th day of cross examining Dr. Bawumia, dealt with issues relating to voting without biometric verification and over-voting which are two of the four categories the witness for the petitioners, Dr. Bawumia outlined in his evidence-in-chief. Justice Sule Gbadegbe one of the justices hearing the petition cautioned lawyers and some social media commentators to be circumspect and decent in their language on issues relating to the petition. Such derogatory comments he said, bring dishonour to the Court.

A retired Justice of the Supreme Court, Justice Stephen Alan Brobbey says the criminal justice system is not properly resourced to work effectively. This he said leads to the delay in criminal cases at the court, hence the need to take a second look at the criminal justice system. Justice Alan Brobbey said this at the 35th anniversary of the Ghana Bar Association Martyrs day memorial lecture in Accra.
