New Orleans, Louisiana, United States, September 30, 2015 - Three New Orleans police officers were fired Wednesday (June 15), and a fourth suspended, for their roles in a September 2015 incident in which a handcuffed man was hit several times while seated inside the department's French Quarter station.
Officer Alfred Moran's body-worn camera showed him using his hands to strike the man, who had been arrested for public intoxication shortly before midnight on Sept. 30, NOPD said. The man was sitting on a bench inside the 8th District station on Royal Street at the time, and had argued with Moran prior to the incident.
Three other officers – Lewis Simmons, Christopher Jennings and Jeffery Tyler –witnessed their colleague's use of force, NOPD said, but none of them reported the incident to supervisors, as required by department policy.
The incident came to light the following day during a supervisor's routine review of body-worn camera footage, said NOPD spokesman Tyler Gamble.
NOPD's Public Integrity Bureau launched criminal and administrative investigations. But Moran, Simmons and Jennings were untruthful during the investigation, Gamble said. Tyler, meanwhile, answered honestly when questioned.
The handcuffed man did not require hospitalization, Gamble said, and the department's internal investigation, along with a consultation with the Orleans Parish District Attorney's Office, did not find enough evidence to pursue criminal charges against any of the officers.
Moran, Simmons and Jennings were each fired after Wednesday's disciplinary hearing, while Tyler received a five-day unpaid suspension. All four officers have 30 days to appeal the decision.
I expect our officers to follow the law, to follow our policies and our training and to be honest, NOPD Superintendent Michael Harrison said in a release announcing the disciplinary actions. Today's decision demonstrates that the NOPD is committed to ethical and constitutional policing and that we will not tolerate anything less.
Donovan Livaccari, a police union attorney who represents Moran and Jennings, said Jennings never saw the incident. But camera footage shows his head facing the direction of the bench where the man was sitting, Livaccari said, so the department concluded he must have seen it.
Among many others, we have warned numerous times that video evidence only has value in context of the officer's perception of events and other measurable factors, Livaccari said. In this case, the video evidence, which was inconclusive, was relied on entirely in spite of testimonial evidence to the contrary. Christopher Jennings was a seven-year veteran with a spotless record. It would seem prudent to give more weight to his statements in regard to what he saw or did not see instead of assuming what he saw or did not see based on a video recording. I have already filed an appeal.
Livaccari said that Moran struck the man twice, but does not remember the first time. The second time was done to push away the man's face because Moran thought the man, who Livaccari said was belligerent and intoxicated, was going to bite him or spit at him.
Moran does acknowledge and takes responsibility for not reporting the incident, Livaccari said.
Moran is a four-year veteran recently assigned to the 8th District. He was one of six named defendants in the 2014 federal lawsuit filed by Hervey Farrell, the cabdriver who filmed New Orleans attorney and former radio host Jennifer Gaubert's sexual advances toward him inside his taxi.
The suit accused Moran, then assigned with the 3rd District, and a sergeant of obtaining an arrest warrant for Farrell without investigating allegations made by Gaubert when she initially contacted Moran. The city eventually settled with Farrell.
Simmons, an 8-year veteran, and Tyler, a 28-year veteran, were both assigned to the 8th District. Jennings, a seven-year veteran, was most recently assigned to the 3rd District.

Season One Thank You!
We have been travelling now for three months. We have gotten as far as Texas in the middle of the country. We have celebrated and honored all kinds of cultures. We love what we do and we are grateful to meet all the people and learn all the history we have.
Season 1: The South: Dixieland has a total of seven states in it, seven of the original eleven confederate states. We have seen Fort Sumner, where the Civil War started. We also celebrated the four amazing Walt Disney World Parks in Orlando Florida. We've taken the Daytona Sling Shot, spiraling upward into the air, flying and flipping like crazy, right after a bolt fell out of the machine. We've seen the awesome and honorable state of Georgia. There we trekked to the top of Kennesaw Mountain, where we enjoyed the story of the Confederate soldiers who defended this land. We enjoyed Okefinokee Swamp, holding the snakes and learning of the wonderful story of Oscar the alligator who used to be the boss. We surprised Luci's daughter, Marina, who works at Outback Steakhouse. She greeted us in tears and laughter as she found us waiting at one of her booths, waiting to order.
The adventure continued as we headed into Alabama. We learned of the amazing caves all located underneath the ground. It was amazing for us to look at the amazing formations, and wonderful halls. There was something so simply magnificent at exploring those caves. The De Soto cave is an amazing cave full of majestic and rich history. It is a healing cave, after all. We surprise visited Steve, a childhood friend of Luci's. It was nice to see a friendly face. Steve gripped onto Luci and wouldn't let him go.
We left Alabama to come to Mississippi. We realized just how amazing art can be. The people in Meridian have raised a lot of money to erect amazing wonderful carousel horses around their city. The surplus money from the project goes to Hope Village, a wonderful orphanage. We have also had the honor of eating in Missippi's oldest diner, Weidmann's, who brings peanut butter to your table! They make their peanut butter containers there, and you can actually buy them! I am so glad we got that recommendation.
Onward we went into Louisiana. Jennings and New Orleans were both extraordinarily worth it! An amazing aura of eclectic energy filled the spirit of New Orleans. Music filled the air of every corner. Rare instruments could be heard and seen throughout the French Quarter. Spell shops were scattered around the quarter as well. Voodoo dolls sold on various corners and in stores. Painters set up shop next to war hero General Jackson's monument. The man beloved by the people that kept our amazing New Orleans our eclectic art canvas. Drinks all around, even along the sidewalk! Dogs roaming everywhere and everyone is in such a good mood here, in the one-way street of art.
We passed by so many amazing casinos in Jennings. We learned about Edwin Edwards and Crawfish. We got to hold baby alligators and for the first time, in Louisiana we tried alligator meat! That was awesome. We saw an amazing museum which was a general store in the 1920s, and is now preserved just the way it was when people used to go in and buy from there, the Tupper General Store. We got to see the Lorraine Bridge, which is a simple, but amazing stamp on the history of Lousisiana and her Parishes.
This state is amazing, and really big. Where should I begin? Well we were treated poorly as our hostess and RV Park owner business partner reneged on our deal. Since the Rodeo was in town, she wanted to charge us about triple what we agreed upon, and besides that she had overbooked her park, and given all the reasonable spots away. But we kept going and met a wonderful man named Frank, and his lovely wife Fran. These two took us in, and let us stay in their parkinglot while we got together. Their establishment is an amazing bar that holds church services every Sunday. We were so glad to meet them and we enjoyed our time there.
