Bridging Visa E - It's tricky - Brisbane Migration Lawyer explains
SHOWNOTES
Here are the top 3 things you need to know about the bridging visa E.
1. RE-ENTRY BAN
If you get on a bridging visa E, and then you leave Australia, you will be subject to a 3 year re-entry abn. During that time, you are not able to return to Australia. This means you need think carefully as to whether it's worthwhile staying in Australia on a bridging E, as opposed to going home and applying for a new visa straight away, rather than having to wait 3 years.
2. NO WORK RIGHTS?
If you want to be able to work while holding a Bridging E, you need to show financial hardship. Contact us if you don't know how. Immigration will not easily grant you work rights.
3. INTERVIEW COMPULSORY
You can't just apply for a bridging E and then wait for the outcome. Immigration will wait until your current visa expires, and then they get you in for an interview. An officer will ask about your circumstances, why you can't leave Australia and then they will decide if you qualify. If you are eligible for this visa, you will be granted one on the spot.

Stinson's Plane Wreck Hike, Christmas Creek, Lamington NP QLD
Stinson's Plane Wreck Hike, Christmas Creek, Lamington NP QLD..... on Saturday 3rd August 2019.
Wikilocs here:
A great trail that we pushed through and completed in 3hrs 37mins....to the Plane Wreck and back and with a brief stop at Westray's Grave. Mind you, that is pushing it at a rapid pace with two other young men that were happy to smash the time on this trail!
I always have great respect for the original survivors of this trail and the rescuers that got them out. If you're into the history of the plane crash, here's a really cool movie that was made back in the day about this event:
Worthwhile seeing if you intend hiking to the wreckage to make you appreciate the trail experience more. Loads of ribbon markers on this trail these days - what could go wrong???
Also passed a bunch of crazy wild women that were on their way up when we were descending. Love the fact that those girls weren't scared to tackle this trail, putting a lot of blokes to absolute shame! Good on them - you crazy wild women of Lamington National Park!! I tip my hat off to you... and to the Yowie creature that lives in these parts.
Here's another great plane wreck to visit:
Get out there and explore this big amazing world God has given us, and share the adventure. Enjoy the video.
By the way, if you're into hiking videos, check out my YouTube channel containing videos of some of my hiking expeditions around South East Queensland, Australia. Hope they inspire you to get out and explore this amazing place... ???? LINK HERE:

Step 1: Finances
Whether it’s your first, second or third home, obtain pre-approval from your bank or financial institution, so you know exactly how much you’ve got to spend. Shop around for the best loan and be realistic about what you can afford. Although Australia is currently experiencing a period of historically low interest rates, choosing a fixed-rate home loan or budgeting for some rate increases will give you peace of mind if and when rates do begin to rise. If you’re taking out your first mortgage, take the time to learn about different financial products before deciding which one’s right for you. There are a range of fees you need to pay when you buy a home. You can find out what these are from the Real Estate Institute in your state.
Step 2: Legals
Yes, buying property is a legally binding transaction so unless you’re a law professional yourself, it’s time to call in the experts. A conveyancer or solicitor is the most qualified person to handle the legal side of the home-buying process, including reviewing the contract of sale prior to purchase. The Australian Institute of Conveyancers offers some handy tips on choosing a conveyancer.
Step 3: Go hunting
While house hunting can be fun, the process can be frustrating if you keep missing out on the perfect property. To make finding and securing your dream home simpler, do your research. Ensure you know the value of homes in the area you wish to purchase. Websites such as APM Price Finder can help you get an accurate picture of what you’ll have to pay for the type of dwelling you’d ideally like. Consider the experience of experts when deciding which areas to target and what sort of home to buy. Especially if you are a first-home buyer, you can avoid costly mistakes by making good decisions early. Establishing a good rapport with real estate agents in your target area is worthwhile. If an agent knows what you’re looking for, you may be the first person they call about newly listed properties that match your wish list.
Step 4: Understand the sales method
Residential property in Australia is usually sold via one of two methods:
Auction: a sale usually in public, by an auctioneer, in which property is sold to the highest bidder
Private treaty: a sale negotiated directly between the parties or their agents.
There are pros and cons to each, but understanding how they work makes buying easier. If you are buying by private treaty, you can make an offer ‘subject to finance’ or ‘subject to building inspection’. When you bid at an auction, you are agreeing to purchase the property for the price indicated and you must have carried out any pre-purchase inspections before you place a bid.
Step 5: Building inspection
It’s easy to overlook having a building inspection carried out on a property you’re interested in, but these reports can save you thousands of dollars down the track, so they are worth every cent. If you’re planning to bid on a property at an auction, have the building inspection done early so you have enough time to consider its findings before auction day.
Step 6: Negotiate
So you’ve found the property, had the building inspection and you’d like to be the successful purchaser. Now for the nitty-gritty. Whether it’s an auction or a private treaty, buying a home involves negotiation. Negotiation isn’t a skill we all have, so if you’re nervous about bidding at auction or negotiating privately with a real estate agent, consider using a buyer agent to handle the process for you.
Step 7: Settlement and settling in
While much of the settlement – including the final title search, cheque directions and so on – will be handled by the banks and your legal representatives, taking an active role in the process is vital.

What is LVR?
LVR is a commonly used acronym in the mortgage and property industry, but do you know what it means or how it applies to home purchases?
LVR stands for Loan to Value Ratio. It is the percentage of money you borrow for a home loan compared to the value of the property. It is used to assess your risk factor as a borrower; lenders will calculate your LVR before deciding whether or to approve you for a home loan. The higher your LVR is, the more of a risk you may be to your lender.
Calculating LVR
When calculating your LVR, a lender will look at the property’s value and your deposit to determine how much you will need to borrow. The lender will subtract your deposit from the purchase price and then divide the remaining amount by the property value.
For example, if you wish to purchase a $400,000 property and have a $100,000 deposit saved, you will need to borrow $300,000. Being three-quarters of the home’s price, this would be an LVR of 75%.
Be wary of a high LVR
An LVR of 80% or lower is the best place to be as a borrower. Home loans which are over 80% LVR are considered high risk. As a result, most lenders will charge extra fees, such as Lender’s Mortgage Insurance (LMI), in order to protect themselves in case you default.
Another risk of a higher LVR is that you will have larger home loan repayments. You may find that you can manage the repayments at the moment, but what about in 6 months? What about a year from now? There is a distinct possibility that interest rates will rise; if so, would you still be able to handle the repayments? During your pre-purchase research, you may find that it would be more worthwhile saving for a larger deposit now, waiting an extra few months before buying and securing yourself a lower LTV.
Australia The NBN 1.mp4
Video best viewed at 480p or better.
If you watch this, give me some feedback on your thoughts afterwards. Thanks.
One, as yet undebated reason why I think the investment in the full NBN (National Broadband Network) will be a worthwhile national investment for Australia.
I grew up in Sydney, moved to a regional city mid 80's, now live in a rural area. My view comes from an on the ground practical view point.
To my view, a single wholesale NBN is the best way to enable a level playing field for competition between the telcos. It is also an efficient way to correct the increasing demographic imbalance between city/metro and regional Australia. Currently about 90% of our population is in city/metro areas, and 10% live in regional and remote areas. This means crowded over stressed cities, and sparse population over regional areas that still require a base level of services. When the population imbalance between city and regional areas is to extreme, costs go up both ends. To my view a 80% city to 20% regional would be a better balance for national efficiency.
For a country of vast distances and sparse population the NBN opens up for some city/metro people the chance to move to regional areas that they have wanted to make, but limited work and telecommunications has to date deterred them. From my visits to Sydney, this is a significant group of people.
The NBN enables alternate net base employment opportunities in regional areas, as well as lower cost in regional areas to re-base city businesses. It provides access to normal telecommunications services for daily living. All in an open, less stressed, regional environment.
If people want a ticket out of capital city life, the NBN, if done fully and properly, can provide the opportunity for relocating to regional areas with options of work and better lifestyle. This in turn leads to decreased pressure on infrastructure in cities, and better cost per capita use of existing infrastructure and services in regional areas. This demographic rebalance provides the national efficiency gain I see with the NBN.
In the long term, I see the NBN as the most efficient way to achieve better demographic balance. Once established, all one is moving over large distances to maintain new economic activity is photons. No vast multi-billion dollar investments in relocating industries, building railways, moving freight, moving physical goods. The NBN is very very energy efficient once established in this regard. Try decentralising with any other solution!
As for cost, $43 Billion for the NBN. It seems a lot. But, then have a look at how many $ Billions we are spending to meet the overloaded roads, public transport etc in the increasingly densely over populated capital cities. The total costs of these projects over just the next 10 years nationally, within State and National budgets, is much more than $43 Billion price tag of the NBN . It is in the 100's of Billions. Some of that infrastructure money will still need to be spent in the cities, and some still spent in regional areas, but less overall with a better national demographic balance.
The NBN works for 50, 100, 200 years once the fibre is in the ground. That is a lot of time to benefit from the billions in annual cost saving through the national efficiency of a more efficient distribution of our population.
For these reason I believe a fully implemented NBN is in our national interest.
Thanks. Cameron NSW.
Visa refused/cancelled? - You can appeal - Find out how.

Oszkar Denes, immigration lawyer practising in Queensland, explains what to do if your visa has been cancelled or your visa application was refused.
If your visa was cancelled or your application was refused, you have 3 options:
1. You go home - but obviously that's not an attractive option
2. You can apply for a new visa - but in many cases, due to legislative restrictions, you may not be able to do this while you are still in Australia
3. You appeal.
In this video, Oszkar discusses the following avenues for appeal:
1. You ask the Department of Home Affairs to review their decision internally - in most cases, this will not resolve the problem.
2. You apply to the Administrative Appeals Tribunal for a merits review. If you want to succeed, you should seriously consider getting a lawyer
3. You appeal to the Federal Court or Federal Circuit Court. In many cases, you can only do this once you have exhausted your other appeal rights. If you wanted to succeed in the Federal Court, you should definitely get yourself a lawyer.

Australian Student Visa Considered For Cancellation?
Are you an international student studying in Australia on a student visa? Have you received a letter from Immigration telling you that they are considering to cancel your visa? When you receive this letter, you have a couple of days to respond.
Here are a few things to keep in mind:
#1 DON'T IGNORE THE LETTER
If you ignore the letter, they will cancel your visa. Plain and simple.
Also, remember this: even if they have grounds to cancel your visa, you might have reasons why your visa should still not be cancelled. Have you breached a particular condition? You might be able to explain it.
#2 IS IMMIGRATION CORRECT?
Consider whether Immigration's allegations are correct. For example if they say you breached the work limitation condition, but you think they are wrong, it's worthwhile fighting the point. Obviously you need evidence, but the point is, don't automatically assume that they are right and you are wrong.
#3 IF IMMIGRATION IS CORRECT...
You might still have grounds why the visa should not be cancelled. For example you may not have been able to comply with visa conditions due to injury or illness. If so, this is your opportunity to say so.
Make sure your arguments are comprehensive and supported by evidence.
# IF IMMIGRATION CANCELS YOUR VISA
Unfortunately, the reality is that despite best efforts, it may not be possible to prevent cancellation. We have seen a number of cases where Immigration have adopted a very strict approach.
If your visa is cancelled, the number one priority is to get another visa, to ensure you are not an illegal non-citizen. For example, you can apply for a bridging visa E:
Next, consider if you want to appeal the decision. In most cases an appeal is possible. The appeal will be decided by the AAT (Administrative Appeals Tribunal). Even if Immigration cancelled your visa, the AAT may decide to reinstate it, so this may well work for you.
NEED ASSISTANCE?
We can help with:
1) Responding to Immigration
2) Advising whether you should appeal a cancellation
3) Representing you before the AAT if you appeal a cancellation.

Dear World Leaders, Welcome to Brisbane: Yet another G20 poem
Dominant discourses regarding the G20 seem to treat economic growth as an end goal in and of itself, when really the end goal should be improving the welfare of the world's poorest people. Economic growth is much less worthwhile if the super-rich are the only ones who benefit.
This piece is intended to trigger a bit of thoughtful discussion about global economic inequality and hierarchical governance systems. There are many more issues I would've liked to raise, but there's only so much you can squeeze into a two-minute poem. Hopefully this will at least help kickstart the conversation.

Living in Brisbane, it is so convenient to hop in the car and head down to the Gold Coast. Most summers my friends and I spend every weekend down that way soaking up the warm sun and relaxing on the varies beaches. This summer I made some new friends who took me to the local Currumbin Rockpools which is very inland without signage... (TIP: Google maps only takes you to the end of the stream if you follow the road it takes you all the way up to magnificent hidden waterfalls and natural waterslide) It was a nice day trip full of adventure and good company. It really reminded me to see new places and keep on roaming the unknown and trusting it'll all work out. Gold Coast has such diverse landscapes, from hinterlands to the coastline plus Surfers Paradise is Tourism Heaven, it is a very popular vacation spot for Australians because it has it all from great restaurants and bars to thrilling rides, shows and fun parklands for children.
March 4th to April 15th, 2018: Gold Coast and some areas in Brisbane are Hosting the Commonwealth Games! It's an exciting event for our area and I'm sure will showcase the beauty that is the Gold Coast. I'm a big Olympics and Commonwealth Games watcher but unfortunately I'm away in Thailand at the time it's airing. When I was six I went to Sydney Olympics and in 2006 Melbourne hosted the Commonwealth Games which my family and I watched a few of the events. I love the spirit and ceremonies highlighting the achievements in sport and unity the games hold for so many countries.
I really hope you enjoyed seeing a glimpse of what Gold Coast has to offer, I would highly recommend checking it out for yourself, it's sunny all year around! I forgot to get down to the Theme Parks but they are worthwhile.

Wild Horse Lookout - Glass House Mountains, QLD
This Sunday Aimfit was pleased to be able to take the crew up the short but very steep Wild Horse Mountain Lookout. This lookout is situated 40 mins from Bray Park and is an easy access walk for a great pay off. The views at the top of Wild Horse Mountain are stunning and we were all blown away with what we could see. The crew did a fantastic job tackling the climb, with husbands and kids and even granddads joining in the fun. With only one crazy Aimfitter joining me to tackle it a second time, it certainly is a short and challenging but worthwhile climb.
How to Survive Flying Emirates Economy Class (Top Tips)
I flew Emirates A380 economy class from Dubai to Zurich. In the video, I gave 8 good tips on how to survive or how to enjoy economy class flying. I am sure you will benefit from some of the tip I gave!
The video also shows you the children's kit and meal on Emirates. Also Ramadan Iftar boxes are shown in the video. Enjoy the magnificent forward wing view with engine on the A380!
--------
Join me for a relaxed and fun flight from Dubai to Zurich with Emirates. I travel aboard the Airbus A380 aeroplane in Emirates economy class and I reveal eight tips and tricks on how you can enjoy and get the most out of your economy class flight. We can’t all experience the luxury of flying first class but this video aims to show that it certainly isn’t impossible to have a very enjoyable, relaxing and comfortable flight in economy class with just a little prior planning, research and thought.
In this video, I also specifically examine some of the comforts offered by the Emirates airline within their economy class to help their customers. One thing we focus on is Emirates’ provision for children and we examine the complimentary items including blankets, bibs, baby wipes and colouring in books which are given out to families with young children.
Tip #1 – Even if you’re flying in economy class, try and access a credit card lounge before the flight to make yourself more comfortable and prepared for boarding. You’re more likely to start the flight in a better mood and in a more positive state of mind, especially if you’ve had to wait at the airport for a while, if you’ve had something to eat, had a comfortable seat to sit on and been in relaxed and more quiet surroundings. If you are not eligible to enter one of these lounges, consider paying for entry; it is likely to be well worth your investment as one of the biggest reasons why people do not enjoy their flight in economy class is because they were not in the right frame of mind to begin with.
Tip #2 – Use a website such as expertflyer.com to see where clusters of empty seats are on the flight that you wish to take. By using this website, you may be able to purchase seats from the airline’s website which are in a quieter spot, with less people surrounding you. expertflyer.com can show real time seat maps for your flight up to one hour before the departure of the flight, letting you make an informed decision as to the best seat location for you in economy class.
Tip #3 – Use a website such as seatguru.com to get to know the layout of the economy class on your flight better so that you can select more advantageous economy seats with views over the engines, or, perhaps most importantly, with more leg room. There’s almost always a few economy seats with much, much more leg room than others because of the free space that has to be left in front of the aircraft’s mid-placed emergency exit.
Furthermore, after coming on board, if there’s a very favourable seat which is vacant and unsold, grab it before anybody else does!
Tip #4 – If you can, travel in the low season when fares are lower and when planes are less crowded. Low season months are February, May and November.
During my flight in Emirates economy class, I was able to move around to a large number of different seats as, travelling in May, it was low season. I was also able to lie down over a complete row of four economy seats and get a quality rest as if I was in business class, but without business class prices! If you can, it certainly pays dividends to travel in economy class when it’s less busy in the low season.
Tip #5 – Always bring a bottle of water with you to stay hydrated and avoid excessive alcohol consumption which can dehydrate you. Additionally, always bring an eye-shade with you so that you can get quality rest whenever you need it; these are provided on some longer haul flights but it’s always best to have your own, just in case.
Tip #6 – Wear something loose and comfy to promote good well being and also good blood circulation whilst you’re up in the air. This is especially important when the flight is crowded and/or there isn’t a lot of leg room and movement is restricted. This follows on to…
Tip #7 – Wherever possible, stretch your limbs and walk around the cabin – it doesn’t just help keep your blood circulating in what can be a cramped economy class but it keeps your mood happy too. Feeling confined and restricted in economy class is a big source of uncomfortable economy class flights.
Tip #8 – Stay smiling and stay positive whenever travelling in economy class. Don’t forget to bring your headphones with you to listen to some of your favourite tunes whilst you’re in the sky!

Moved to to Airlie Beach this winter. These are some of the jumps that will stick in my mind for along time. Pretty gutted I rushed my turn and didn't drag a toe in the ocean is was perfect conditions.
To friends new and old, sharing these epic memories with awesome people makes it so worthwhile.
