Gene Forte was arrested for double felonies for allegedly attacking a judge after supposedly fighting with 5 deputies for over an hour directly below the court hallway surveillance camera.
DA Morse says the only taped evidence they have is the 3 minutes of the outside courthouse view of Forte being walked down the street to the jail. after his arrest.
The DA says that the tape from the hallway that would have shown Forte attacking the judge had been written over.
You can tell from the zooming in of the camera that a person was operating the filming remotely from inside the courthouse.
Forte's public defense attorney, Barbara O'Neill, refused to ask the DA who the operator of the camera was, the operator who thought it was more important to preserve the tape from the outside filming than the one that would have captured the over an hour alleged confrontation with the deputies in the hallway.

This week, on the Mariposa County Update show, County Supervisor Marshall Long provided an update on the actions of the Mariposa County Board of Supervisors. He had, as his special guest, Rick Peresan, the IT Director for Mariposa County. Mr. Peresan provided some insight into his job of maintaining the Internet and Telecommunications systems in, and around, the Oldest operating Courthouse in the Western United States.

The History of The Mother Lode in ASL
A survey of the history of the Mother Lode region during the California Gold Rush, with a focus on Mariposa County. Presented in American Sign Language.
Historic Burke County Courthouse/Sam J. Ervin Jr
Historic Burke County Courthouse
James Binnie, a Scottish builder, was awarded the contract in 1833. He built the courthouse of native stone quarried on the Forney plantation about four miles north of Morganton. Frederick Roderick, a German stonemason who later established his home in Burke County, assisted Mr. Binnie with the construction. The building was put into use in 1837.
During the Civil War, on April 17, 1865, Major General George Stoneman occupied the building and destroyed most of the County’s records.
In 1885, the exterior of the building was covered with stucco, and in 1903, a major renovation designed by architect Frank Milburn of Columbia, SC raised the porticos and replaced the simple classical cupola with an elaborate one of Baroque style, giving the courthouse its present appearance.
A monument to Burke County’s Confederate Army troops was erected on the northwest corner of the Square in 1911 and was paid for by public subscription. The bronze statue of the soldier was added in 1918. The statue was a gift from Captain William Joseph Kincaid, a Burke County Confederate soldier, who settled in Griffin, Georgia after the war.
Also found on the Square is a memorial rose garden given in memory of Bob Byrd (1930-2001), a prominent Burke County attorney and a statue of Sam J. Ervin, Jr., a Burke County native, who served in the US Senate from 1954 to 1974.
George Stoneman, Jr. (August 8, 1822 – September 5, 1894) was a United States Army cavalry officer, trained at West Point, where his room-mate was Stonewall Jackson. In the Civil War, he became Adjutant to George B. McClellan, who did not appreciate the use of centralized cavalry, and was therefore outperformed by the Confederates, who did.
Stoneman was governor of California between 1883 and 1887.
Samuel James Sam Ervin, Jr.
He graduated from the University of North Carolina, where he was a member of The Dialectic and Philanthropic Societies.
During his Senate career, Ervin was a legal defender of the Jim Crow laws and racial segregation, as the South's constitutional expert during the congressional debates on civil rights.Ervin served as the legal advisor to the local sheriff during the hunt for Broadus Miller, a black man believed to have murdered a teenaged white girl. The county officials invoked the outlaw provision of the North Carolina constitution which permitted any citizen to kill a declared outlaw without formal charges being brought. Miller was shot down while being pursued and his body displayed in the local courthouse square.
Ervin gained lasting fame through his stewardship of the Senate Select Committee to Investigate Campaign Practices, also known as the Senate Watergate Committee, from the 1972 presidential election.
