Blue Bell to now inform states of positive listeria tests
HOUSTON (AP) -- Blue Bell Creameries signed agreements with health officials in Texas and Oklahoma on Thursday requiring the company to inform the states whenever there is a positive test result for listeria in its products or ingredients.The requirement comes after the Brenham, Texas-based company failed to tell federal or state health officials of repeated findings of listeria at its Oklahoma plant that date back to 2013.State and federal regulatory agencies play an important role in food safety, and we hope that it will be reassuring to our customers that we are working cooperatively with the states of Texas and Oklahoma in taking the necessary steps to bring Blue Bell Ice Cream back to the market, the company's president and CEO, Paul Kruse, said in a statement.The agreements call for Blue Bell to report within 24 hours any presumptive positive test result for listeria found in ingredients or finished product samples from the company's facilities in Brenham and Broken Arrow, Oklahoma. Such reporting will be required for two years once ice cream products return to the market and could be extended.Blue Bell said it is working on a similar agreement with Alabama, where it also has a plant.All of the company's plants have been shut down since Blue Bell issued a full recall in April after more of its products tested positive for listeria. The company's ice cream has been linked to 10 listeria illnesses in four states, including three deaths in Kansas.The agreements announced Thursday do not require Blue Bell to immediately notify Texas and Oklahoma of any presumptive positive test results for listeria that might have been found on floors or other surfaces that don't have contact with food.Food and Drug Administration investigation findings released last week showed the company had found 17 positive samples of listeria on surfaces and floors in its Oklahoma plant dating back to 2013. The FDA said it was never told of these repeated findings of listeria.Carrie Williams, spokeswoman for the Texas Department of State Health Services, said her agency didn't call for Blue Bell to notify it of a positive test result related to things like floors and other surface areas because it wouldn't necessarily mean there is a problem in the product. We put a priority on knowing what's in the finished ice cream.We'd absolutely want to have full access to those results so we can see where the positive occurred and whether it was found near food production areas, she said.Stan Stromberg, director of the food safety division for the Oklahoma Department of Agriculture, Food and Forestry, said his agency wasn't as concerned about testing samples related to surfaces that don't have contact with food.Once the plant starts running again, we will ask to see those results every time we are in the plant, he said. In the past ... they weren't required to provide them to us. Now they have to provide them to us.The FDA supports the agreements and will be working with Blue Bell and our state and local partners to review corrective actions taken at the Blue Bell facilities, said agency spokeswoman Lauren Sucher.The agreements also require Blue Bell to notify Texas and Oklahoma at least two weeks before it plans to start producing ice cream for sale and to also conduct a trial product run.Blue Bell also will implement a test and hold program for at least a year in which ice cream products must test negative for listeria before they are released for sale. The company will retain an independent sanitation or microbiology expert to ensure methods and procedures are in place to prevent contamination.Blue Bell Creameries has said it will be at least several months before its products are back in stores.Listeria illness generally only affects the elderly, people with compromised immune systems, pregnant women and their newborn infants. Blue Bell issues voluntary recall
BRENHAM, Texas (AP) Texas-based Blue Bell Creameries issued a voluntary recall Monday night for all of its products on the market after two samples of chocolate chip cookie dough ice cream tested positive for listeria, a potentially deadly bacteria.
The company cannot say with certainty how the bacteria was introduced to its facilities, Blue Bell's chief executive Paul Kruse said in a statement.
Blue Bell issued the recall that includes ice cream, frozen yogurt, sherbet and frozen snacks distributed in 23 states and international locations because other products have the potential to be contaminated, according to the statement.
We're committed to doing the 100 percent right thing, and the best way to do that is to take all of our products off the market until we can be confident that they are all safe, Kruse said.
The first recall in the family-owned creamery's 108-year history was issued last month after the U.S. Centers for Disease Control and Prevention linked ice cream contaminated with listeria to three deaths at a Kansas hospital.
Five others in Kansas and Texas were sickened with listeriosis, which can cause fever, muscle aches, gastrointestinal symptoms.
The illness was tracked to a production line in Brenham, Texas, and later to a second line in Broken Arrow, Oklahoma. The most recently contaminated samples were discovered through a testing program the company initiated after its first recall, according to the statement.
Monday's recall extends to retail outlets in Alabama, Arizona, Arkansas, Colorado, Florida, Georgia, Illinois, Indiana, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Nevada, New Mexico, North Carolina, Ohio, Oklahoma, South Carolina, Tennessee, Texas, Virginia, Wyoming and international locations.
The manufacturing facility in Oklahoma where operations were suspended earlier this month for sanitizing will remain closed as Blue Bell continues to investigate the source of the bacteria, the statement said.
Blue Bell is implementing a process to test all of its products before releasing them to the market, with plans to resume limited distribution soon.
The company said it is also expanding its cleaning and sanitization system, beefing up its employee training, expanding its swabbing system by 800 percent to include more surfaces and is sending daily samples to a microbiology laboratory for testing.
Listeria primarily affects pregnant women and their newborns, older adults and people with immune systems weakened by cancer, cancer treatments, or other serious conditions.

WASHINGTON (AP) -- Blue Bell ice cream had evidence of listeria bacteria in its Oklahoma manufacturing plant as far back as March 2013, a government investigation released Thursday says. The company then continued to ship ice cream produced in that plant after what the Food and Drug Administration says was inadequate cleaning.Three listeria deaths in Kansas are now linked to the ice cream. The company recalled all of its products last month, following several smaller recalls.The FDA released its investigations into Blue Bell's plants in Oklahoma, Texas and Alabama after a Freedom of Information request by The Associated Press. The most extensive violations were found in Oklahoma, where the FDA released 16 separate positive tests for listeria on equipment and in ice cream from March 2013 through January 2015.Blue Bell did not immediately respond to a phone call or email seeking comment.Violations in the Oklahoma plant include dirty equipment, inadequate food storage, food being held at improper temperatures and employees not washing hands adequately.There were also violations at the Texas and Alabama plants. In Alabama, FDA investigators observed at least two employees working with the food wearing soiled clothing. In Texas, investigators saw condensation dripping directly into food and onto surfaces that came directly in contact with food. In all of the plants, the FDA found dirty equipment and infrastructure that made cleaning difficult.Listeria generally only affects the elderly, people with compromised immune systems, pregnant women and their newborn infants. It can cause fever, muscle aches and gastrointestinal symptoms. The worst cases are fatal. It can cause miscarriage, stillbirth, premature labor, and serious illness or death in newborn babies.The bacteria are found in soil and water that can be tracked into a facility or carried by animals. Listeria can be very difficult to get rid of once it contaminates a processing facility, partly because it grows well in refrigeration. on a hot day like today we wanted to try our own unscientific experiment we're gonna put this thermometer in our car and go run some errands and come back.
we've been gone now for about 20 minutes and taking a look at the thermometer it now reads 108 degrees, authorities tell us 107 can be lethal.
